1. Scope of Application
1.1. For the business relationship between Office- und Kopiermanagement 2000 KG, Nürnberger Straße 52-54, 95448 Bayreuth (hereinafter referred to as "Seller") and the customer, the following General Terms and Conditions shall apply exclusively.
1.2. A Consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor attributable to their independent professional activity. An Entrepreneur is a natural or legal person who acts in the exercise of their commercial or independent professional activity when concluding a legal transaction.
2. Offers and Service Descriptions
The presentation of products in the online shop does not constitute a legally binding offer. All offers are valid "while stocks last" unless otherwise noted.
3. Ordering Process and Conclusion of Contract
3.1. The customer can place products in the shopping cart without obligation. By clicking the button "Order with obligation to pay", the customer submits a binding offer to purchase.
3.2. The purchase contract is only concluded when the Seller dispatches the product within 2 days (7 days for entrepreneurs) or confirms the dispatch via a second email.
4. Prices and Shipping Costs
All prices include the currently applicable statutory value-added tax. Additionally incurred shipping costs will be clearly communicated during the ordering process.
5. Delivery, Availability of Goods
5.1. In the case of prepayment, delivery takes place after receipt of payment.
5.2. If the product is not available through no fault of the Seller (e.g., failure of sub-suppliers to deliver), the Seller may withdraw from the contract. Any payments already made will be refunded immediately.
6. Payment Modalities
The customer can choose from the payment methods available during the ordering process. In the case of purchase on account, payment is due within 30 days of receipt. When using third-party providers (e.g., PayPal), their terms and conditions apply.
7. Retention of Title
The goods remain the property of the Seller until full payment has been made. For entrepreneurs, supplementary regulations regarding extended retention of title apply.
8. Customer Account
The Seller provides a password-protected customer account. Customers are obliged to treat their access data confidentially and to update their information in the event of changes (e.g., address).
9. Warranty for Defects and Guarantee
9.1. Statutory liability for defects applies.
9.2. For entrepreneurs, the limitation period for material defects is generally one year from the transfer of risk. Used goods are excluded from the warranty for entrepreneurs.
10. Liability
The Seller has unlimited liability in cases of intent, gross negligence, and injury to life, body, or health. In the case of slight negligence, the Seller is only liable for the breach of essential contractual obligations.
11. Storage of the Contract Text
The customer can print the contract text before submitting the order. The Seller stores the contract text and sends the customer the order data as well as the GTC by email.
12. Final Provisions
12.1. The place of performance and jurisdiction for entrepreneurs is the registered office of the Seller (Bayreuth).
12.2. The contract language is German.
12.3. Online dispute resolution: http://ec.europa.eu/consumers/odr/. We are not obliged to participate in a dispute resolution procedure before a consumer arbitration board.
